2013 PREVENTION HIGHLIGHTS

    1. MEDICAL AMNESTY ENACTED - "It's not a crime in KY to call 911 in an alcohol emergency."

2013 ALCOHOL BILLS ENACTED INTO LAW

HB 221 (BR-428): AN ACT relating to local option elections.
  1. Exempt listed projects/ districts from precinct vote in favor of prohibition if precinct is within a qualifying city

  2. Governor signed into law. Passed the House 95-5. Passed the Senate 29-6.

SB 13 (BR-84): AN ACT relating to the sale of alcoholic beverages on election days.
  1. Permit the sale of distilled spirits and wine on any primary or regular, local option, or special election day

  2. HFA3 (House Floor Amendment) includes recommendations from the 2012 Governor’s Task Force on Alcohol Laws, and creates a new section of KRS 244 to establish medical amnesty for minors reporting an alcohol overdose, and amends KRS 244 related to disorderly premises.

  3. Medical Amnesty, per Heather Parrino from the BRICC Coalition and University of Louisville, a university with a Good Samaritan Policy, “…is meant to encourage minors to seek emergency medical attention, several universities have created policies and several states have enacted statutes, which confer limited immunity from criminal prosecution for certain crimes when emergency medical attention is needed because of alcohol consumption.  Such statutes are known as Medical Amnesty or Good Samaritan laws.”

  4. Governor signed into law on 04/04/2013. Passed the House w/HFA3 & HFA4 50-46. Passed the Senate w/HFA3 & HFA4 27-11.
